Terms of Service

These Terms govern your use of Cal Factor (the “App”) and the related services we provide (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.

Eligibility & account

You must be at least 13 years old (16 in the EU/UK) to use Cal Factor. You’re responsible for the security of your account credentials and for all activity under your account. Tell us at support@calfactor.app if you suspect unauthorized access.

Cal Factor provides nutrition estimates for general informational purposes only. It is not medical, dietary, or nutritional advice and is not a substitute for professional consultation. Do not rely on Cal Factor for medical decisions, diagnosis, or treatment. If you have a medical condition or specific dietary needs, consult a qualified healthcare professional.

AI output

Cal Factor uses generative AI to identify foods and estimate calories and macros. The output:

You retain ownership of the photos and inputs you provide. You grant us a limited licence to process them through the AI provider only for the purpose of returning a result to you.

Your content

You own the content you create in Cal Factor (meals, recipes, notes, photos). You grant us a non-exclusive licence to host and process that content for the purpose of running the Service. We do not sell your content. We do not use your content to train AI models.

If you mark a recipe as “public” (a feature that may be enabled in future versions), you also grant other Cal Factor users the right to view it within the App. You can unshare it at any time.

Subscriptions & payment

Cal Factor is free to use. We may offer optional paid tiers (e.g. “Pro”) with additional features and higher AI limits. If you subscribe:

Service availability

We aim to keep Cal Factor available, but we don’t guarantee uptime. The AI features depend on third-party providers and may be temporarily unavailable, slow, or rate-limited. We may change, suspend, or discontinue parts of the Service at any time.

Termination

You can stop using Cal Factor at any time and delete your account from Settings. We may suspend or terminate your account if you violate these Terms or if continued use poses a risk to other users or to the Service. We’ll provide notice unless doing so would compromise security or break the law.

Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranty of any kind, express or implied, including without limitation the warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate.

Limitation of liability

To the maximum extent permitted by law, Cal Factor and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of your use of the Service. Our aggregate liability for any claim arising out of these Terms is limited to the amount you paid us in the twelve months preceding the claim, or USD 50, whichever is greater.

Some jurisdictions don’t allow these limitations; in those places, our liability is limited to the maximum extent permitted by law.

Governing law & disputes

These Terms are governed by the laws of the jurisdiction in which Cal Factor is operated, without regard to conflict-of-law principles. You and we agree to resolve disputes through binding individual arbitration where allowed by law, except for small-claims matters or claims for injunctive relief related to intellectual property.

Changes to these Terms

We may update these Terms from time to time. Material changes will be notified in the App. Continued use after a change means you accept the updated Terms.
